This instruction is based on the Order of the Ministry of Labor and Social Protection of the Republic of Kazakhstan dated November 22, 2002 No. 273-p "On approval of the Qualification Directory of positions of managers, specialists and other employees" and in accordance with the requirements of the Labor Code of the Republic of Kazakhstan dated 05/15/2007 No. 251-III and is applied as an appendix to the employment contract. 1.1 The General Director belongs to the category of managers, is accepted and dismissed by the decision of the general meeting of the founders of the LLP "..............". JOB DESCRIPTION OF THE CEO 1.2. According to the specifics of his activities, the CEO should know:
Legislative and regulatory legal acts regulating the production, economic, financial and economic activities of the enterprise, resolutions of federal, regional and local government authorities that determine the priority directions of economic development and the relevant industry;
Methodological and regulatory materials of other bodies related to the company's activities;
Profile, specialization, and structural features of the company;
Prospects for the technical, economic and social development of the industry and enterprise;
Production facilities and human resources of the enterprise;
The technology of production of the company's products;
Tax and environmental legislation;
The procedure for drawing up and approving business plans for the production, economic, financial and economic activities of the enterprise;
Market methods of business management and enterprise management;
A system of economic indicators that allow an enterprise to determine its position in the market and develop programs for entering new markets;
The procedure for concluding and executing business and financial contracts;
Market conditions;
Scientific and technical achievements and best practices in the relevant industry;
Management of the economy and finances of the enterprise, organization of production and labor;
The procedure for developing and concluding industry-specific tariff agreements, collective agreements, and regulating social and labor relations;
Labor legislation;
Labor protection rules and regulations.
Job responsibilities
2.1. Manages the production, economic, financial and economic activities of the enterprise in accordance with the current legislation, bearing full responsibility for the consequences of decisions taken, the safety and effective use of the enterprise's property, as well as the financial and economic results of its activities.
2.2. Organizes the work and effective interaction of all structural divisions, workshops and production units, directs their activities towards the development and improvement of production, taking into account social and market priorities, improving the efficiency of the enterprise, increasing sales volumes and increasing profits, quality and competitiveness of products, their compliance with international standards in order to win domestic and foreign markets and meeting the needs of the population in the relevant types of domestic products.
2.3. Ensures that the company fulfills all obligations to regional, regional and local budgets, state extra-budgetary social funds, suppliers, customers and creditors, including bank institutions, as well as business and employment contracts and business plans.
2.4. Organizes production and economic activities based on the widespread use of the latest equipment and technology, progressive forms of management and labor organization, scientifically sound standards of material, financial and labor costs, market research and best practices (domestic and foreign) in order to globally improve the technical level and quality of products (services), economic efficiency production, rational use of production reserves and economical use of all types of resources.
2.5. Takes measures to provide the company with qualified personnel, the rational use and development of their professional knowledge and experience, the creation of safe and healthy working conditions, compliance with the requirements of legislation on environmental protection.
2.6. Ensures the correct combination of economic and administrative management methods, unity of command and collegiality in discussing and resolving issues, material and moral incentives to increase production efficiency, the application of the principle of material interest and responsibility of each employee for the work assigned to him and the results of the work of the entire team, the payment of wages on time.
2.7. Together with the labor collectives, ensures compliance with labor and industrial discipline, promotes the development of labor motivation, initiative and activity of workers and employees of the enterprise.
2.8. Resolves issues related to the financial, economic and production activities of the enterprise, within the limits of the rights granted to it by law, entrusts the management of certain areas of activity to other officials - deputy directors, heads of production units and branches of enterprises, as well as functional and production units.
2.9. Ensures the observance of legality in the activities of the enterprise and the implementation of its economic relations, the use of legal means for financial management and functioning in market conditions, strengthening contractual and financial discipline, regulating social and labor relations, ensuring the investment attractiveness of the enterprise in order to maintain and expand the scale of entrepreneurial activity. 2.10. Protects the property interests of the company in court, arbitration, public authorities and management.
Rights
The CEO has the right to: 3.1. To represent the interests of the company in relations with individuals and legal entities, public authorities and management bodies; 3.2. To act on behalf of the company, without issuing a power of attorney. 3.3. Open settlement and other accounts in banking institutions; 3.4. Responsibility
The General Director is responsible; 4.1. For non-fulfillment (improper fulfillment) of his official duties; for offenses committed in the course of his employment; 4.2. For causing material damage within the limits defined by the current labor legislation of the Republic of Kazakhstan. 4.2. For the consequences of decisions taken by him that go beyond the limits of his powers established by law, the charter of the organization, and other regulatory legal acts. The Director is not exempt from liability for actions involving liability performed by persons to whom he has delegated his rights.
